2. Acceptance of Terms

By accessing and using SpeaksToMe, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

3. Service Description

SpeaksToMe provides AI-generated personalized audiobooks created from your individual preferences and responses. Each audiobook is uniquely generated for you using artificial intelligence and professional text-to-speech technology.

4. Eligibility

You must be at least 18 years old to create an account and use SpeaksToMe. By using our service, you represent that you are 18 years of age or older.

While you must be an adult to use our service, some products (such as Christmas Stories) are designed to create content for children as listeners. Adults create and purchase these audiobooks for children to enjoy.

5. Pricing and Payment

Pricing is clearly displayed before purchase. All payments are processed securely. Payment must be received before audiobook generation begins.

5.1 Gift Cards

Gift cards may be purchased for personal gifting. Each gift card is duration-specific (30-minute or 60-minute) and can only be redeemed for audiobooks of the matching duration. Gift cards:

• Are single-use only
• Expire one year from purchase date unless otherwise specified
• Are non-refundable and non-transferable once issued
• Cannot be redeemed for cash
• May include optional personalization (sender name and message)

5.2 Voucher Codes

We may offer promotional voucher codes from time to time. Voucher codes:

• May be single-use or multi-use as specified
• May be duration-specific or universal
• Have expiration dates as specified in the promotion
• May have usage limits (e.g., first 100 redemptions)
• Cannot be combined with other offers unless explicitly stated
• May be revoked if obtained through unauthorized means

5.3 Credits System

Credits represent pre-purchased audiobook generation rights. Credits:

• Are duration-specific (30-minute or 60-minute)
• Can only be applied to audiobooks of the matching duration
• Are automatically applied when creating audiobooks (oldest first)
• May be converted to gift cards (this conversion is irreversible)
• Expire 3 years from purchase unless otherwise specified
• Are non-refundable and non-transferable

6. No Refund Policy

All sales are final. Due to the high computational cost of AI generation, premium voice synthesis, and the personalized nature of our service, we do not offer refunds once payment has been processed and generation has begun.

You have the opportunity to review and approve your audiobook outline before payment is required. By completing payment, you acknowledge and agree to our no-refund policy.

7. Intellectual Property and Usage Rights

Your Rights: You receive a personal, non-exclusive, non-transferable license to use the audiobook generated for you. You may download and keep your audiobook indefinitely for personal use.

Restrictions: You may not:

• Redistribute, sell, rent, lease, or share the generated audiobook
• Use the audiobook for any commercial purposes
• Publicly broadcast or perform the audiobook
• Reverse engineer or attempt to extract our AI prompts, algorithms, or proprietary methods
• Use the service to generate harmful, defamatory, illegal, or inappropriate content
• Misrepresent the audiobook as your own original work

Our Rights: SpeaksToMe and Realtime Technologies Ltd retain all intellectual property rights to the platform, software, AI prompts, and generation methods.

7.1 PDF Transcripts

All completed audiobooks include a complimentary PDF transcript containing the full script, cover art, and metadata. PDF transcripts:

• Are provided free of charge with every audiobook
• Are subject to the same usage restrictions as the audio file
• May be downloaded indefinitely for personal use
• Cannot be redistributed, sold, or used for commercial purposes

8. User-Generated Content

When you provide information to our service, you represent and warrant that:

• You own or have the right to use the content you provide
• Your content does not infringe on any third-party rights
• Your content complies with all applicable laws and regulations

You grant SpeaksToMe a limited license to use your provided content solely for the purpose of generating your personalized audiobook and improving our service.

9. Service Availability and Quality

We strive to provide high-quality audiobooks, but we do not guarantee:

• Uninterrupted or error-free service
• That the service will meet all your specific requirements
• That AI-generated content will be free from all errors or inaccuracies

Generation times may vary based on audiobook length and system load. We aim to complete generation within a reasonable timeframe but cannot guarantee specific completion times.

10. Disclaimer

Important: SpeaksToMe audiobooks are for informational and entertainment purposes only. They are not medical advice, professional counseling, therapy, or a substitute for professional consultation. Always consult qualified professionals for medical, mental health, or professional concerns.

11. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our service
• Use automated systems (bots, scrapers) to access our service without permission
• Create multiple accounts to circumvent service limitations
• Submit false or misleading information

12. Account Termination

We reserve the right to suspend or terminate your account and access to the service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users, us, or third parties
• Violates applicable laws or regulations

You may delete your account at any time through your account settings. Upon deletion, you will lose access to your audiobook library after the minimum retention period (see Privacy Policy).

13. Data and Privacy

We collect and process personal information as described in our Privacy Policy. Your questionnaire responses are used solely to generate personalized content and improve our service. By using SpeaksToMe, you consent to our data practices as outlined in the Privacy Policy.

14. Limitation of Liability

To the fullest extent permitted by law, Realtime Technologies Ltd and SpeaksToMe shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the service
• Damages resulting from AI-generated content inaccuracies
• Damages resulting from third-party services we integrate with

In no event shall our total liability exceed the amount you paid for the specific audiobook giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless Realtime Technologies Ltd, SpeaksToMe, and our affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you provide (questionnaire responses, uploaded scripts)

16. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or through the service. Your continued use of SpeaksToMe after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of SpeaksToMe shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Realtime Technologies Ltd regarding your use of SpeaksToMe.
